He has to send his senators to place their arguments in congress. And in turn try to convince other senators, and other members of Congress to pass legislation that relinquishes the president's use of the national guard in that situation. Or if it's very extreme, congress can impeach the president. That's your balance of powers there. You can have some random judge or a governor from a lower level challenge the use of the president's executive power.
